These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you," "user," or "customer") and Seaview Painting & Stucco ("Company," "we," "us," or "our"), a painting and stucco contractor operating in Stuart, Florida and the surrounding Treasure Coast area.

By accessing or using our website at seaviewpainting.com, submitting a contact or estimate request form, calling our business, or receiving communications from us, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, please do not use our website or services.

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated effective date. Your continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.

Seaview Painting & Stucco provides residential and commercial painting, stucco repair, stucco installation, pressure washing, paver sealing, epoxy flooring, and related services. All services are subject to:

• •A written estimate provided prior to work commencement
• •Customer approval of the estimate and scope of work
• •Availability of our crew and scheduling capacity
• •Weather conditions and site accessibility
• •Compliance with applicable Florida building codes and contractor licensing requirements

Estimates are valid for 30 days from the date of issuance unless otherwise stated. Seaview Painting & Stucco reserves the right to decline any service request at our discretion.

Seaview Painting & Stucco operates its SMS communications program in full compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, Federal Communications Commission (FCC) regulations, and the guidelines established by the CTIA (Cellular Telecommunications Industry Association).

A. Express Written Consent

By submitting your mobile phone number through our contact form, estimate request form, or any other channel, you provide express written consent — as required under 47 C.F.R. § 64.1200 and FCC rules — to receive autodialed, pre-recorded, or artificial voice text messages (SMS/MMS) from Seaview Painting & Stucco. Consent is not a condition of purchase of any goods or services.

G. No Third-Party Sharing of SMS Consent

Your mobile phone number and consent to receive SMS messages will never be sold, rented, shared, or transferred to any third party for their marketing purposes. Your number is used exclusively for communications directly related to your service relationship with Seaview Painting & Stucco.

Payment terms are outlined in your individual service estimate or contract. Standard terms include:

• •A deposit may be required prior to scheduling or purchasing materials
• •Final payment is due upon completion of work unless otherwise agreed in writing
• •Accepted payment methods include cash, check, and electronic payment (as specified at time of estimate)
• •Returned checks are subject to a $35 returned check fee in addition to any bank charges
• •Unpaid balances may accrue interest at the maximum rate permitted under Florida law

In the event of non-payment, Seaview Painting & Stucco reserves the right to pursue all remedies available under Florida law, including but not limited to the filing of a contractor's lien pursuant to Chapter 713, Florida Statutes.

We understand that circumstances change. Our cancellation policy is as follows:

• •Cancellations made 48 or more hours before a scheduled start date will be accommodated without penalty
• •Cancellations made less than 48 hours before a scheduled start date may result in forfeiture of any deposit paid
• •If Seaview Painting & Stucco must cancel or reschedule due to weather, crew availability, or other operational reasons, we will notify you promptly and reschedule at no additional cost
• •Deposits are non-refundable if materials have already been purchased for your project

Seaview Painting & Stucco stands behind the quality of our work. Unless otherwise specified in writing:

• •Interior and exterior painting work is warranted against peeling, blistering, or premature paint failure for one (1) year from the date of completion, under normal conditions
• •Stucco repair and installation work is warranted for one (1) year from completion against workmanship defects
• •Warranty does not cover damage caused by water intrusion, structural movement, acts of nature, or failure of customer-supplied materials
• •Warranty is void if the painted or coated surface is subjected to abnormal wear, improper cleaning, or modifications made by others after completion

Manufacturer warranties on paint and materials are separate from our workmanship warranty and are subject to the terms of the respective manufacturer.

Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Key data handling commitments include:

• •We do not sell, rent, or share your personal information with third parties for marketing purposes
• •Your contact information is used solely to provide and communicate about requested services
• •We implement industry-standard security measures to protect your data
• •You may request access to, correction of, or deletion of your personal data at any time

To the fullest extent permitted by applicable law:

• •Seaview Painting & Stucco's total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim
• •We are not liable for indirect, incidental, consequential, punitive, or special damages of any kind
• •We are not responsible for delays or failures in SMS message delivery caused by mobile carriers, network outages, or third-party service providers
• •We are not liable for pre-existing damage to surfaces, structures, or property that was not disclosed prior to commencement of work
• •Our liability for website use is limited to the maximum extent permitted under Florida law

Nothing in these Terms limits our liability for gross negligence, willful misconduct, or personal injury caused by our employees or contractors.

To ensure quality workmanship and project success, customers agree to:

• •Provide accurate information regarding the scope, condition, and location of work
• •Ensure safe and unobstructed access to the work area on the scheduled start date
• •Disclose any known hazardous materials (e.g., lead paint, asbestos) prior to work commencement
• •Remove or protect personal belongings, furniture, and valuables from work areas
• •Notify us promptly of any concerns or changes to the agreed scope of work
• •Ensure payment is made according to agreed terms

Our services are available throughout Martin County, St. Lucie County, Palm Beach County, and surrounding areas in Florida, including but not limited to Stuart, Palm City, Jensen Beach, Hobe Sound, Port St. Lucie, Jupiter, and Fort Pierce.

Services are available to property owners and authorized agents of property owners. By requesting services, you represent and warrant that you have the legal authority to authorize work on the subject property.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

In the event of a dispute arising from or related to these Terms or our services, the parties agree to attempt to resolve the dispute informally by contacting us first at info@seaviewpainting.com. If informal resolution is not successful within 30 days, disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Martin County, Florida.

Nothing in these Terms prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.

All content on seaviewpainting.com — including text, images, logos, graphics, and design — is the property of Seaview Painting & Stucco or its content suppliers and is protected by applicable copyright and intellectual property laws.

You may not reproduce, distribute, modify, transmit, or create derivative works from any content on this website without our prior written consent.
